CHAPTER 50: Major Changes to Hawaii Food Safety Regulations  –  based on the 2009 FDA Model Food Code

Replaces old Chapter 12

Higher Annual Renewal and Permit Fees – increase depends on establishment type and physical size (allows hiring of more inspectors).  Started 2/24/14!

More Frequent Health Inspections – goal is avg. 3 X per year, depending on risk potential and history

More Sanitarians (Health Inspectors) –  Not yet fully staffed – not sure when

Web-Based Food Inspection System –  available for public viewing NOW

Placard System

  • To be placed immediately following an inspection
  • Clearly visible to the general public and patrons
  • Green (Pass)  One Critical violation or less, corrected on site
  • Yellow (Conditional Pass)  Two or more Critical Violations, even if all corrected on site, or one critical not corrected on site – follow-up inspection within two business days, one if the facility notifies the DOH all is corrected
  • Red (Closure)  Imminent public health hazard – Health Dept. will work with you to reopen

Raw or Undercooked – needs consumer advisories

New Temperature Danger Zone – 41° – 135° (formerly 45° – 140°, may need updating or adjusting cold holding equipment).  No excuses like “we’ve been in and out of that cooler all day long!”  Commercial cold holding equipment is designed to hold food at 41° or below even when opened frequently.  If yours doesn’t it needs to be adjusted/repaired.

Timing

  • Health Inspections with placards started Monday, July 21, 2014
  • Expect a Health Inspector at any time
  • Health Inspectors are still not getting to restaurants as quickly as promised, but are doing the best job they can.  Your next Health Inspection could be any day.
